Fresh Site
Client agreement
Last changed 30 October 2026.
This agreement is between Fresh Site and the client named on their private offer page or in the approval email. It is made when the client accepts it on that page, by typing their full name and ticking the box, or replies to the studio's email saying they approve the preview. That page or email, with this agreement, is the whole agreement. Questions or cancellation: hello@freshsite.com.au.

The parties
The studio: Fresh Site (ABN 91 477 328 282), a sole trader, hello@freshsite.com.au.
The client: the firm or person named on their private offer page or in the approval email, at the email address they give when accepting or that sends the approval.

The service
The studio rebuilds the client's current website on a new design, as shown in the preview the client approved. That includes:
- every page of the current site, rebuilt one for one;
- the client's own wording, kept as written wherever it fits, with every fact about the client carried word for word;
- any linking copy the new design needs, written in the client's voice and shown in the preview;
- photographs generated for the site, or the client's own photographs in their place;
- a contact form that sends to the inbox the client chooses;
- switching the client's domain to the new site, with the client;
- hosting the site and looking after it for the first year, as set out under Hosting below;
- one round of corrections to facts and wording before the site goes live.
Not included: articles written for searches (the studio's "Boost your website" pack, an add-on), other ongoing marketing, advertising or search work, new pages, content on subjects the current site does not cover, logo design, and changes after the grace week beyond the care described under Hosting. Any of these can be quoted separately, in writing, before work starts.
-
The price
The price for building the site is AUD 2,000, paid once. No GST is charged while the studio is not registered for GST.
Nothing is paid up front. The client pays nothing in the grace week set out below, and the invoice is due when that week ends.
While the studio is not registered for GST the invoice is not a tax invoice. It shows the studio's name, ABN, the date, the work and the amount in Australian dollars, and is paid by bank transfer.
Hosting and care for the first year are included in the price. After that they are AUD 25 a month, billed yearly (AUD 300 a year), as set out under Hosting below.
The client keeps paying, directly, for their own domain name and email.
-
Approval
Approval is given on the client's private offer page, by typing their full name and ticking the box, or by a reply to the studio's email that says the client approves the preview and wants it to go live. A phone call alone is not approval.
Within 5 business days of the approval, the studio sends the client a copy of this agreement, by email where the client has agreed to receive it that way. The cooling-off period below runs from that copy.
-
Cooling-off: 10 business days to cancel
The client may cancel this agreement for any reason within 10 business days, counting from and including the day after the client receives this agreement. Saturdays, Sundays and public holidays in the client's state are not business days.
To cancel, the client tells the studio in any way, spoken or written: for example by email to hello@freshsite.com.au, or with the termination notice at the end of this page. No reason is needed and nothing is payable.
The studio does not accept or ask for any payment during the cooling-off period. If the grace week ends first, the invoice waits until the cooling-off period has ended.
If the client cancels in the cooling-off period, nothing is payable, even if the site has already gone live: the studio takes it down and helps the client point their domain back to their old site. The preview, made before the agreement, is the studio's own cost.
If the studio has not given the client this notice and this information, or has otherwise not met its obligations under the unsolicited consumer agreement rules of the Australian Consumer Law, the client may have longer to cancel: up to 3 months, or 6 months in some cases. These rights are in addition to any other rights the client has under the Australian Consumer Law.

The grace week
The grace week starts at the start of business on the day after the client says yes, whatever day that is, and runs for 7 days. The site goes live on the client's domain as soon as the domain records change, and the client pays nothing in that week.
When the week ends the invoice is due. If it is not paid, the studio takes the site down and the client's domain can be pointed back to their old site, with the studio's help.
During the grace week the client may ask for small changes beyond the corrections included under The service. They are charged at AUD 100 an hour and added to the invoice. The studio does not think the site will need them, and would rather the client spent that time on the business and on their Google reviews.
The grace week and the cooling-off period run side by side. The cooling-off period is the client's legal right to cancel. The grace week is the studio's own promise that the client sees the site working on their domain before paying for it. Neither takes anything away from the other.
-
Hosting
The studio hosts the site and looks after it. That is part of the package: the client does not need an account anywhere or anyone technical on their side.
The studio hosts every site it builds and does not offer it any other way. Looking after it means keeping the site online, secure and up to date.
Hosting and care for the first year are included in the price. After that they are AUD 25 a month, billed yearly (AUD 300 a year). The studio sends a reminder by email before each renewal.
Care plus is optional, at AUD 99 a month: it includes hosting, an hour of changes each month and a monthly search report. The client asks for it in writing.
The client can change their own words, photos, videos and links at any time at no cost at /cms; other changes are AUD 100 an hour.
The client tells the studio if their phone number or email address changes, so reminders and invoices reach them.
-
Ownership
The client owns their domain, their content, their photographs (including the photographs generated for their site) and their words, and may take them anywhere at any time. The studio never reuses the client's content or photographs for anyone else.
The code the site is built on stays the studio's. If the client leaves, the studio returns the client's content, photographs and words in a form another provider can use, and helps the client point their domain wherever they choose.
-
The domain switch
Once the client says yes, the client, or someone they choose, changes the records at the place their domain is managed so it points to the new site. The studio never asks for a password. Email records are not changed. The previous records are noted first so the switch can be reversed.
-
If the client does not go ahead
If the client says no, does not approve, or cancels in the cooling-off period, the studio deletes the preview and the material made for it, takes the site down if it is already live, and nothing is payable.
-
Liability
To the extent the law allows, the studio's total liability under this agreement is limited to the fee paid for the site. Nothing in this agreement excludes, restricts or changes any guarantee, right or remedy the client has under the Australian Consumer Law that cannot lawfully be excluded.
-
Governing law
This agreement is governed by the law of New South Wales, Australia.
